Terms of Use

1. Acceptance

By installing or using the My Food AI app ("the App") or visiting our website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be 13+ (and 16+ in EEA/UK unless you have parental consent). The App is for consumer, informational use only.

3. License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on iOS (and Android when available) solely for your personal, non-commercial use in accordance with these Terms.

4. User content & image handling

You own the photos you submit. You grant us a limited license to process your photos solely to provide the analysis results. When you save a search, a small thumbnail of the original image is stored alongside your results so you can recognize past searches. Full-resolution images are deleted after processing.

You can delete any saved search (and its thumbnail) at any time, or delete your account to remove everything. Don't upload images of people or content you don't have rights to.

5. AI-generated content & health disclaimer

The App uses artificial intelligence to analyze food menus and ingredient labels. AI-generated results are informational only and may be inaccurate, incomplete, or misleading.

Allergy and dietary safety warning: The App does NOT guarantee the identification of all allergens, ingredients, or dietary conflicts. AI analysis is non-deterministic, meaning the same input may produce different results at different times. Results may miss hidden ingredients, cross-contamination risks, or regional recipe variations.

You must not rely solely on the App for allergy or dietary safety decisions. Always verify ingredients directly with the restaurant, manufacturer, or food provider. Consult a qualified healthcare professional for medical dietary advice.

The App is not a medical device, does not provide medical or nutritional advice, and is not a substitute for professional guidance. You use the App's suggestions entirely at your own risk.

Moon Apps LLC expressly disclaims all liability for any adverse health outcomes, allergic reactions, or injuries arising from reliance on AI-generated results.

6. Subscriptions & billing

The App offers auto-renewing subscriptions which may include a free trial period. Subscriptions are billed by Apple (and Google when available) through your platform account. You can manage or cancel your subscription at any time in your platform account settings. Refunds are handled by the respective platform under its policies.

We may change pricing for future subscription periods with reasonable notice. Price changes do not affect your current billing period.

7. Prohibited uses

You agree not to: engage in unlawful activity; infringe intellectual property rights; reverse-engineer, decompile, or disassemble the App; scrape or bulk-extract data; attempt to bypass security measures, rate limits, or access controls; upload others' personal data; or use the App for commercial purposes without our written consent.

8. Intellectual property

The App and its content (excluding your photos) are owned by Moon Apps LLC or its licensors. All rights not expressly granted are reserved.

9. Feedback

If you send suggestions or feedback, you grant us a royalty-free, perpetual, irrevocable license to use them without obligation to you.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI-GENERATED CONTENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI RESULTS WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MOON APPS LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, ALLERGIC REACTIONS, HEALTH COMPLICATIONS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP OR RELIANCE ON AI-GENERATED CONTENT.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE APP IS LIMITED TO THE GREATER OF USD $50 OR THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Moon Apps LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your reliance on AI-generated content for dietary or health decisions.

13. Dispute resolution

Any dispute arising from these Terms will first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes will be resolved through binding arbitration administered under the rules of the American Arbitration Association, conducted in Wyoming, USA. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

14. Termination

You can stop using the App and delete your account at any time. We may suspend or terminate access for breach, risk, or legal reasons. Sections 5, 8-13 survive termination.

15. Modifications

We may update these Terms at any time. Material changes will be communicated via in-app notice or by updating the "Effective" date. Continued use after changes constitutes acceptance.

16. Governing law & venue

These Terms are governed by the laws of Wyoming, USA (without regard to conflict of law principles). To the extent litigation is permitted, exclusive jurisdiction lies with the courts of Wyoming.

17. Apple-required terms

These Terms are between you and Moon Apps LLC, not Apple. Apple has no obligation to maintain or support the App. To the extent any warranty exists, Moon Apps LLC is responsible; Apple's warranty obligations are limited to any refund of the purchase price (if applicable). Apple isn't responsible for claims relating to the App (product liability, legal compliance, consumer protection, IP). You represent you're not in an embargoed country or on a restricted list. Apple and its subsidiaries are third-party beneficiaries and may enforce these Terms.
